• No Medical Advice or Endorsement: Makeover Fund does not provide medical advice, consultation, diagnosis, or treatment. The content, materials, and information available on our platform are intended for general informational purposes only and should not be relied upon as medical advice. Makeover Fund does not endorse, recommend, or guarantee the services of any particular physician, clinic, or medical procedure. It is your responsibility to seek professional medical advice from a qualified healthcare provider before making any decisions regarding cosmetic or reconstructive surgery.
• User Responsibility: You are solely responsible for conducting thorough research and due diligence when selecting a physician, clinic, or medical procedure. This includes, but is not limited to:
  • Consulting with multiple board-certified physicians. Reviewing each physician’s qualifications, technique, and safety records.
  • Reading patient reviews and testimonials to assess the experiences of others.
  • Understanding the potential risks, complications, and long-term outcomes associated with the chosen procedure.
  • Avoiding travel outside of the United States for cosmetic surgery, as medical standards and regulations may vary.
• Risks and Liabilities: All medical procedures, including cosmetic and reconstructive surgery, carry inherent risks, including but not limited to infection, scarring, anesthesia complications, disfigurement, permanent impairment, and death. By using the Makeover Fund platform, you acknowledge and accept these risks. Makeover Fund shall not be held responsible or liable for any injury, loss, or damage, including loss of life, arising from or related to your decision to undergo any medical procedure.
• Prohibited Procedures: Makeover Fund does not support or facilitate crowdfunding for extreme modification surgeries that result in 'unnatural results.' 'Unnatural results' are defined as procedures that drastically alter the body's appearance in ways that are beyond the scope of generally accepted cosmetic practices, potentially leading to health risks or long-term harm. Furthermore, Makeover Fund does not support or facilitate crowdfunding for gender reassignment surgery. Campaigns that violate these guidelines will be subject to removal from the platform.
• No Guarantee of Success: Makeover Fund does not guarantee the success of any crowdfunding campaign. The platform provides tools and resources to help users share their stories and seek financial support, but it does not guarantee that a user will reach their fundraising goal. Campaign success depends on various factors, including but not limited to campaign visibility, donor engagement, and the individual merits of each campaign.
• Platform Use: You agree to use the Makeover Fund platform in accordance with all applicable laws and regulations. You shall not use the platform for any illegal, fraudulent, or deceptive purposes. Makeover Fund reserves the right to suspend or terminate your account and remove any content or campaigns that violate these terms or any applicable laws.
• Intellectual Property: All content, materials, and information provided on the Makeover Fund platform, including but not limited to text, graphics, logos, and software, are the intellectual property of Makeover Fund or its licensors. You may not use, reproduce, distribute, or display any content from the platform without the express written consent of Makeover Fund.
• Indemnification: By using Makeover Fund, you agree to indemnify, defend, and hold harmless Makeover Fund, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including but not limited to reasonable attorney’s fees and costs, arising out of or in any way connected with:
  • Your use of the platform.
  • Your reliance on any information provided through the platform.
  • Your participation in any fundraising campaign.
  • Your decision to undergo any medical procedure, including but not limited to cosmetic or reconstructive surgery.
  • Any breach of these terms and conditions by you.
  • This indemnification includes, but is not limited to, claims or liabilities arising from personal injury, loss of life, property damage, or financial loss.
• HIPAA Compliance: As part of your use of the Makeover Fund platform, you may voluntarily choose to share personal health information (PHI) or other sensitive data. Please be aware that Makeover Fund does not act as a covered entity or business associate under the Health Insurance Portability and Accountability Act (HIPAA). Therefore, any PHI shared on the platform is not subject to HIPAA protections. You are sharing this information of your own free will and are responsible for safeguarding your own personal health information. We recommend that you carefully consider the information you choose to share and take appropriate measures to protect your privacy.
• Voluntary Use: The use of the Makeover Fund platform is entirely voluntary. Makeover Fund does not recommend or encourage anyone to undergo cosmetic or reconstructive surgery. The decision to pursue such procedures is solely your own, and you should thoroughly consider all risks and consult with qualified medical professionals before making any decisions. Makeover Fund disclaims any responsibility for the outcomes of any medical procedures pursued through funds raised on this platform.
• Donor Protections: Donors who choose to contribute to campaigns on Makeover Fund do so at their own discretion. Makeover Fund does not guarantee that funds raised will be used for the intended purpose, nor does it oversee the spending of raised funds by campaign creators. However, Makeover Fund is committed to ensuring the integrity of its platform and will take reasonable steps to identify and prevent fraudulent activity. If Makeover Fund identifies or suspects fraud in a campaign, we reserve the right to investigate and, if necessary, refund donations made to that campaign. Donors are encouraged to carefully review the details of each campaign and make contributions only if they feel confident in the legitimacy of the campaign and the intended use of funds. Donations are generally non-refundable unless fraud is identified, and donors should be aware that they may not be able to recover funds once contributed. We encourage donors to consider their contributions as gifts and to give only what they can afford to lose without expectation of return.
• Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles.
